

THE MUSLIM INTELLECTUALS’ DILEMMA
Faizan Mustafa, Tahir Mahmood and the Manusmriti–Hindutva Question: Why Prof. Shamsul Islam’s Challenge Cannot Be Ignored

There is a disturbing intellectual question emerging from two recent interventions in The Indian Express: when eminent Muslim academics interpret the words of the RSS leadership or defend the historical reputation of Manusmriti, where does legitimate scholarship end—and where does ideological rehabilitation begin?
The controversy deserves serious scrutiny not because disagreement with Hindutva is a prerequisite for being a Muslim intellectual, but because the historical record of the RSS, the social prescriptions of Manusmriti and the constitutional transformation of India cannot simply be wished away through generous reinterpretation.
At the centre of this controversy are two distinguished Muslim academics—Prof. Faizan Mustafa and Prof. Tahir Mahmood—and their sharply criticised positions on Mohan Bhagwat and Manusmriti.
Opposite them stands Prof. Shamsul Islam, a retired Delhi University political scientist whose scholarship has for decades focused on the documentary history and ideology of the RSS. His intervention raises a fundamental question:
Can a contemporary reading of Hindutva be separated from the ideological history of the organisation that created it?

I. FAIZAN MUSTAFA AND THE BHAGWAT QUESTION
Prof. Faizan Mustafa’s recent Indian Express article, published on August 31, 2026, carries the provocative headline:
“Mohan Bhagwat’s Hindutva is not narrow. Are his words in New York heard in India?”
Mustafa argues that in an atmosphere of hatred and “othering”, one hopes the RSS chief will use his influence to promote tolerance and accommodation.
This is not an isolated intervention.
In December 2024, Mustafa wrote that liberals and minorities should value Mohan Bhagwat’s words, describing the RSS chief as someone who, because of his influence over the masses and government, could potentially restore sanity, tolerance and accommodation.
Earlier, in 2022, Mustafa wrote that Bhagwat could potentially lead what he described as a “Hindutva’s perestroika”, arguing that his dialogue with prominent Muslims could help search for common ground.
And in 2021 he published an article titled:
“Mohan Bhagwat is right: British are to blame for India’s Hindu-Muslim division.”
None of this automatically makes Mustafa an RSS supporter.
That conclusion would require evidence.
But it does create a legitimate investigative question:
What happens when an academic repeatedly asks minorities and liberals to place confidence in the intentions of the RSS leadership while the organisation’s historical ideological texts continue to raise fundamental questions about citizenship, minority status and the meaning of Hindu nationalism?
That is the question Prof. Shamsul Islam forces into the debate.

II. THE MANUSMRITI BATTLE
The second controversy is potentially even more consequential.
Prof. Tahir Mahmood’s August 31, 2026 article in The Indian Express is titled:
“Don’t read Manusmriti through colonial lens.”
His argument is that Manusmriti and other Dharmashastra texts must be understood in their historical context and that modern readers should not automatically assume that their prescriptions were intended to be literally followed in every age.
That is a legitimate scholarly proposition worthy of debate.
But there is another question:
Does contextualising Manusmriti become a defence of Manusmriti?
That distinction is crucial.
A historian may explain a discriminatory text without endorsing it.
A constitutionalist may study an anti-democratic doctrine without supporting it.
A scholar may reconstruct the historical context of patriarchy without asking society to rehabilitate patriarchy.
The real issue, therefore, is not whether Manusmriti should be studied.
Of course it should.
The issue is whether historical contextualisation can erase the substance of the discriminatory prescriptions contained in the text—or its subsequent political appropriation.

III. SHAMSUL ISLAM’S DOCUMENTARY COUNTERATTACKll
This is where Prof. Shamsul Islam’s intervention becomes significant.
Islam has spent years documenting the RSS’s ideological history from RSS and Hindutva sources themselves.
His central argument is devastatingly simple:
Do not judge the RSS merely by what its present leadership says. Judge it also by what its foundational ideological texts and publications have said.
Islam has repeatedly drawn attention to the November 30, 1949 editorial in the RSS publication Organiser, published immediately after the Constituent Assembly adopted the Constitution.
According to the text reproduced by Islam, Organiser complained that the Constitution contained no reference to the ancient constitutional tradition of Bharat and specifically praised the laws of Manu.
This historical evidence creates a problem for any attempt to discuss Manusmriti as merely an innocent ancient philosophical text.
Because the question is no longer:
“Was Manusmriti historically important?”
It obviously was.
The question becomes:
“Why did an important ideological organ of the RSS invoke Manusmriti while rejecting the constitutional framework created by the Constituent Assembly?”
That is an entirely different question.

IV. MANUSMRITI IS NOT ONLY ABOUT TRANSLATION
Prof. Mahmood’s emphasis on colonial interpretation raises an important scholarly issue: translations can distort ancient texts.
But even if every disputed translation were corrected, another question would remain:
What does the Sanskrit text itself say?
Shamsul Islam has reproduced passages concerning women that describe them in deeply hierarchical terms, including injunctions that women should remain under male dependence.
The controversy therefore cannot be settled simply by saying:
“William Jones mistranslated it.”
If a translation is wrong, correct it.
If a verse has been taken out of context, restore its context.
If its historical meaning has been misunderstood, explain the correct meaning.
But after doing all that, the intellectual responsibility remains:
Let the original text stand before the reader.
Only then can Indians decide whether Manusmriti deserves historical study, cultural respect, constitutional relevance—or merely historical examination.

V. THE AMBEDKAR QUESTION THAT CANNOT BE ESCAPED
There is another historical fact that makes the Manusmriti controversy particularly sensitive.
On December 25, 1927, during the Mahad movement, Dr. B.R. Ambedkar and his followers publicly burned a copy of Manusmriti as a symbolic rejection of caste hierarchy.
That act was not a colonial translation exercise.
It was an Indian anti-caste protest led by one of the principal architects of modern India’s constitutional order.
And therein lies the extraordinary historical contradiction.
Ambedkar rejected Manusmriti as a symbol of caste oppression.
The Constitution rejected hereditary hierarchy in favour of equality before law.
Yet sections of Hindu nationalist thought historically continued to invoke Manu as part of India’s ancient civilisational tradition.
Shamsul Islam’s writings document this ideological tension extensively.
Therefore, the Manusmriti debate is not merely an argument between Sanskrit scholars.
It is a debate about which India Indians are being asked to inherit.

VI. THE RSS’S OWN RECORD MAKES THE QUESTION HARDER
Islam’s scholarship also points to the writings of V.D. Savarkar and M.S. Golwalkar.
Savarkar’s concept of Hindutva placed considerable emphasis on the relationship between India as fatherland and holy land, creating a distinction between communities whose sacred geographies were located within India and those whose holy lands lay elsewhere.
Golwalkar’s We or Our Nationhood Defined went considerably further in discussing minorities and the place they should occupy within a Hindu national framework.
Islam has spent years placing these texts alongside contemporary RSS statements.
His argument is therefore not simply:
“I dislike RSS.”
It is:
“Read the RSS’s own texts.”
That is a much more serious challenge.
His official website describes his research focus as religious nationalism, persecution of Dalits and women, the RSS and the erosion of secularism in India.
His work has also specifically documented RSS references to Manusmriti and the historical tension between the Sangh’s ideological tradition and India’s Constitution.

VII. THE REAL QUESTION FOR FAIZAN MUSTAFA
Prof. Mustafa deserves to answer a straightforward question:
What exactly is the test by which Muslims and liberals should trust the RSS leadership?
Is it a speech?
A meeting?
A declaration?
A change in organisational doctrine?
A rejection of discriminatory politics?
A repudiation of historical RSS writings?
Or simply the personal sincerity of Mohan Bhagwat?
If Bhagwat says that Hindutva is broad and inclusive, that statement should certainly be examined.
But the same intellectual standard must be applied to every political organisation.
Words must be tested against institutional conduct and historical doctrine.
A politician cannot be evaluated only by his most conciliatory speech.
Nor should the RSS.

VIII. AND THE QUESTION FOR TAHIR MAHMOOD
Prof. Mahmood’s argument deserves an equally precise question:
If Manusmriti is being rescued from colonial misinterpretation, what precisely is the original text being rescued for?
For historical scholarship?
Fair enough.
For understanding ancient Indian jurisprudence?
Absolutely.
For cultural appreciation?
That is a matter of personal and intellectual judgment.
But if the argument is being used to rehabilitate Manusmriti as a model for contemporary social organisation, then the debate enters an entirely different territory.
The Constitution of India does not derive its authority from Manusmriti.
It derives its authority from:
“We, the People of India.”
That is the decisive constitutional rupture.
India moved from inherited status to citizenship.
From caste hierarchy to equality.
From religiously grounded social status to constitutional rights.
From ancient authority to popular sovereignty.
That transformation is precisely what Ambedkar’s constitutional project represented.

IX. THE MOST IMPORTANT QUESTION: WHO BENEFITS FROM THIS DEBATE ?
This is where the controversy becomes genuinely investigative.
Why is Manusmriti suddenly receiving renewed intellectual attention at a moment when India is debating Hindu nationalism, civilisational identity, the Constitution and the meaning of Hindutva?
And why are Muslim intellectuals being drawn into the process of interpreting or legitimising the ideological language of the RSS?
These questions should not be dismissed as conspiracy theories.
They deserve evidence-based answers.
Shamsul Islam himself has recently criticised what he describes as sections of the Muslim intelligentsia who, in his view, are legitimising the RSS while using Muslims as an alibi.
Whether one accepts his conclusion or not, the underlying question is legitimate:
Can minority intellectuals become so eager to find a moderate face within Hindutva that they stop interrogating the ideological foundations of Hindutva itself?
That is the real controversy.

X. “MUSLIM INTELLECTUAL” DOES NOT MEAN “MUSLIM SPOKESPERSON”
There is another principle that must be defended.
Prof. Mustafa and Prof. Mahmood are academics.
They are entitled to their interpretations.
They do not speak for every Muslim.
Nor does Prof. Shamsul Islam.
The Muslim community is not an intellectual monolith.
There can be Muslim scholars who favour dialogue with the RSS, Muslim scholars who reject the RSS altogether, Muslim scholars who defend Manusmriti as historical literature, and Muslim scholars who regard it as a symbol of caste and gender oppression.
That diversity is healthy.
The problem begins only when academic respectability becomes a substitute for historical evidence.

XI. THE “MUSLIM FACE” OF HINDUTVA ?
This is perhaps the most uncomfortable question of all.
Hindutva does not necessarily require every Muslim to become a Hindutva activist.
It can also benefit politically from Muslim intellectuals who tell other Muslims:
“The RSS is not really what you think it is.”
That does not prove coordination.
It does not prove conspiracy.
It does not prove that any particular Muslim scholar is an RSS agent.
But politically, such arguments can have a consequence irrespective of the speaker’s intention:
They can provide Hindutva with intellectual legitimacy among audiences otherwise suspicious of it.
That consequence deserves examination.

XII. SHAMSUL ISLAM’S CHALLENGE: READ THE ARCHIVES
Perhaps the strongest part of Islam’s challenge is methodological.
He repeatedly asks critics and defenders alike to examine the RSS’s own documentary record.
Not WhatsApp messages.
Not partisan propaganda.
Not anonymous social-media claims.
Not merely what Bhagwat said yesterday.
But the organisation’s own publications, resolutions, ideological texts and historical record.
His work on Manusmriti points to the RSS’s historical invocation of Manu and to passages concerning women and lower castes that he argues cannot simply be erased through modern sanitisation.
That is where the debate should actually take place.

XIII. THE VERDICT SHOULD NOT BE “WHO WON THE DEBATE?”
The real question is much larger.
What kind of India are these intellectual arguments helping to construct?
An India in which Hinduism can be discussed as a diverse religious civilisation?
Yes.
An India in which Manusmriti can be studied academically?
Yes.
An India in which Bhagwat’s conciliatory statements can be welcomed?
Yes.
But simultaneously:
Can the constitutional rights of every Indian be made conditional upon conformity with a majoritarian cultural identity?
No.
Can caste hierarchy be rehabilitated because an ancient text is declared culturally valuable?
No.
Can the historical record of the RSS simply disappear because its contemporary chief makes conciliatory statements?
No.
Can minorities be expected to trust ideology without examining its institutional and historical record?
No.
And most importantly:
Can the Constitution be subordinated to any ancient religious text?
Absolutely not.

XIV. THE FINAL TEST
The debate between Faizan Mustafa, Tahir Mahmood and Shamsul Islam should therefore not be reduced to personalities.
It should become a test of scholarship itself.
To Prof. Mustafa:
Show us the institutional transformation of the RSS—not merely its conciliatory speeches.
To Prof. Mahmood:
Show us the original Manusmriti—and let its defenders answer for every passage, not merely disputed colonial translations.
To Prof. Shamsul Islam:
Continue putting documentary evidence before the public—but allow the evidence to be examined independently, including where interpretations remain contested.
And to every Indian:
Do not allow either Hindutva or its critics to replace evidence with slogans.
The future of India cannot be decided by asking whether Mohan Bhagwat sounds moderate.
Nor can it be decided by asking whether Manusmriti sounds noble after reinterpretation.
The decisive question is simpler:
Does the doctrine under examination uphold the constitutional equality, liberty, dignity and fraternity of every Indian?
If it does, it deserves engagement.
If it does not, no amount of intellectual cosmetics can make it constitutional.
That is the challenge Prof. Shamsul Islam has thrown into the arena.
And that is the question neither the RSS nor its intellectual admirers can permanently avoid:
WHAT COMES FIRST — MANU OR THE CONSTITUTION ?
For the Republic of India, the answer was given on November 26, 1949:

फ़ैज़ान मुस्तफ़ा, ताहिर महमूद और मनुस्मृति का सवाल: प्रो. शम्सुल इस्लाम की चुनौती को नज़रअंदाज़ क्यों नहीं किया जा सकता ?

द इंडियन एक्सप्रेस में प्रकाशित दो लेखों ने भारतीय मुस्लिम बौद्धिक जगत के सामने एक असहज प्रश्न खड़ा कर दिया है। जब प्रतिष्ठित मुस्लिम शिक्षाविद् RSS नेतृत्व की भाषा की सकारात्मक व्याख्या करते हैं या मनुस्मृति को उसके औपनिवेशिक अनुवादों से अलग करके समझने की आवश्यकता पर बल देते हैं, तो सवाल उठता है—वैध अकादमिक पुनर्व्याख्या की सीमा कहाँ समाप्त होती है और किसी विचारधारा के पुनर्वास की शुरुआत कहाँ होती है?
यह विवाद इसलिए महत्वपूर्ण है क्योंकि यह केवल दो व्यक्तियों की राय का विवाद नहीं है। इसके केंद्र में हिन्दुत्व, RSS का इतिहास, मनुस्मृति की सामाजिक अवधारणाएँ और भारतीय संविधान के बीच संबंध का प्रश्न है।
इस बहस के एक ओर प्रो. फ़ैज़ान मुस्तफ़ा और प्रो. ताहिर महमूद हैं; दूसरी ओर प्रो. शम्सुल इस्लाम, जिनका शोध RSS और हिन्दुत्व की वैचारिक तथा दस्तावेज़ी परंपरा पर केंद्रित रहा है।
मूल प्रश्न यह है:
क्या आज के RSS को केवल उसके वर्तमान नेतृत्व के भाषणों से समझा जा सकता है, या उसके ऐतिहासिक दस्तावेज़ों और वैचारिक साहित्य को भी साथ पढ़ना आवश्यक है?

1. फ़ैज़ान मुस्तफ़ा और मोहन भागवत का प्रश्न
प्रो. फ़ैज़ान मुस्तफ़ा ने द इंडियन एक्सप्रेस में मोहन भागवत के न्यूयॉर्क/Madison Square Garden संबोधन और हिन्दुत्व की उनकी व्याख्या पर सकारात्मक दृष्टिकोण प्रस्तुत किया है।
उनका तर्क रहा है कि जब समाज में नफ़रत और “दूसरे” को अलग करने की प्रवृत्ति बढ़ रही हो, तब RSS प्रमुख के ऐसे शब्दों को महत्व दिया जाना चाहिए जो सहिष्णुता और समावेश की बात करते हैं।
यह अपने आप में RSS का समर्थन सिद्ध नहीं करता।
लेकिन यहीं एक गंभीर सवाल पैदा होता है:
क्या किसी संगठन के वर्तमान प्रमुख के उदार शब्द उसके ऐतिहासिक वैचारिक दस्तावेज़ों की जगह ले सकते हैं?
यदि RSS नेतृत्व कहता है कि हिन्दुत्व संकीर्ण नहीं है, तो उस दावे की जाँच केवल भाषण से नहीं, बल्कि संगठन के इतिहास, साहित्य और व्यवहार से भी होनी चाहिए।

2. ताहिर महमूद और मनुस्मृति की बहस
दूसरा और शायद अधिक संवेदनशील विवाद प्रो. ताहिर महमूद के द इंडियन एक्सप्रेस में प्रकाशित लेख से जुड़ा है, जिसमें उन्होंने मनुस्मृति को औपनिवेशिक दृष्टिकोण से पढ़ने के विरुद्ध सावधान किया है।
उनका मूल तर्क है कि मनुस्मृति और अन्य धर्मशास्त्रीय ग्रंथों को उनके ऐतिहासिक संदर्भ में समझना चाहिए और यह मान लेना उचित नहीं कि उनकी प्रत्येक व्यवस्था हर युग में शाब्दिक रूप से लागू होती थी।
एक इतिहासकार के लिए यह एक वैध अकादमिक प्रश्न है।
लेकिन यहाँ एक और प्रश्न उठता है:
क्या मनुस्मृति का ऐतिहासिक संदर्भ समझाना और मनुस्मृति का नैतिक पुनर्वास करना एक ही बात है?
नहीं।
किसी भेदभावपूर्ण ग्रंथ का अध्ययन उसका समर्थन नहीं होता।
किसी प्राचीन व्यवस्था की व्याख्या उसका आधुनिक पुनरुत्थान नहीं होती।
लेकिन यदि ऐतिहासिक संदर्भ देने की प्रक्रिया में उसके असमानतावादी और स्त्री-विरोधी प्रावधानों को गौण कर दिया जाए, तो बहस का स्वरूप बदल जाता है।

3. शम्सुल इस्लाम की दस्तावेज़ी चुनौती
यहीं प्रो. शम्सुल इस्लाम का हस्तक्षेप महत्वपूर्ण हो जाता है।
इस्लाम लंबे समय से RSS के अपने प्रकाशनों और वैचारिक साहित्य को सामने रखकर यह सवाल उठाते रहे हैं कि संगठन को केवल उसके वर्तमान नेताओं के वक्तव्यों से क्यों परखा जाए?
उनका आग्रह है:
RSS को उसके अपने दस्तावेज़ों से पढ़िए।
उदाहरण के लिए, 1949 में संविधान सभा द्वारा संविधान स्वीकार किए जाने के तुरंत बाद RSS के मुखपत्र Organiser में प्रकाशित एक संपादकीय में प्राचीन भारतीय संवैधानिक परंपराओं की चर्चा करते हुए मनु के कानूनों का उल्लेख किया गया था।
इससे एक महत्वपूर्ण ऐतिहासिक प्रश्न पैदा होता है:
यदि संविधान आधुनिक भारत की समानता और नागरिकता की आधारशिला था, तो उस समय RSS के वैचारिक साहित्य में मनु की व्यवस्था को क्यों उद्धृत किया गया?
यह प्रश्न औपनिवेशिक अनुवाद का प्रश्न नहीं है।
यह भारतीय राजनीतिक इतिहास का प्रश्न है।

4. मनुस्मृति का सवाल केवल “अनुवाद” का सवाल नहीं
यदि किसी औपनिवेशिक अनुवाद में गलती है तो उसे सुधारा जाना चाहिए।
यदि किसी श्लोक का संदर्भ गलत समझा गया है तो संदर्भ स्पष्ट किया जाना चाहिए।
यदि पश्चिमी विद्वानों ने मनुस्मृति की गलत व्याख्या की है तो भारतीय विद्वानों को उसका सुधार करना चाहिए।
लेकिन उसके बाद भी मूल प्रश्न बचा रहता है:
मूल संस्कृत पाठ वास्तव में क्या कहता है?
और उससे भी महत्वपूर्ण:
भारतीय समाज ने ऐतिहासिक रूप से उस पाठ का इस्तेमाल किस प्रकार किया?
स्त्रियों, जाति और सामाजिक पदानुक्रम से जुड़े मनुस्मृति के प्रावधानों पर बहस को केवल यह कहकर समाप्त नहीं किया जा सकता कि “औपनिवेशिक अनुवाद गलत था।”
मूल पाठ सामने रखिए।
उसकी विभिन्न विद्वतापूर्ण व्याख्याएँ सामने रखिए।
फिर जनता को निर्णय करने दीजिए।

5. अम्बेडकर को इस बहस से बाहर नहीं किया जा सकता
मनुस्मृति पर चर्चा डॉ. भीमराव अम्बेडकर के बिना अधूरी है।
25 दिसंबर 1927 को महाड आंदोलन के दौरान अम्बेडकर और उनके साथियों ने मनुस्मृति की प्रति जलाकर जातिगत असमानता के विरुद्ध प्रतीकात्मक विरोध दर्ज कराया था।
यह किसी ब्रिटिश अनुवादक की प्रतिक्रिया नहीं थी।
यह भारत के भीतर से उठी सामाजिक न्याय की एक शक्तिशाली चुनौती थी।
और यहीं आधुनिक भारत का सबसे बड़ा वैचारिक परिवर्तन दिखाई देता है:
मनुस्मृति की सामाजिक पदानुक्रम वाली परंपरा बनाम संविधान की नागरिक समानता।
भारत का संविधान व्यक्ति की जाति, जन्म या सामाजिक स्थिति के आधार पर उसका मूल्य निर्धारित नहीं करता।
उसका आधार है:
न्याय, स्वतंत्रता, समानता और बंधुता।

6. असली सवाल फ़ैज़ान मुस्तफ़ा से
प्रो. फ़ैज़ान मुस्तफ़ा से एक सीधा अकादमिक प्रश्न पूछा जाना चाहिए:
RSS पर विश्वास करने का मापदंड क्या होना चाहिए?
क्या एक भाषण?
क्या एक मुलाकात?
क्या एक सार्वजनिक घोषणा?
या फिर संगठन के वैचारिक साहित्य और व्यवहार में वास्तविक परिवर्तन?
यदि मोहन भागवत समावेशिता की बात करते हैं, तो उन शब्दों का स्वागत किया जा सकता है।
लेकिन वही कसौटी सभी राजनीतिक संगठनों पर लागू होनी चाहिए।
शब्दों की जाँच संस्थागत आचरण और ऐतिहासिक रिकॉर्ड से होनी चाहिए।

7. और प्रो. ताहिर महमूद से प्रश्न
यदि मनुस्मृति को औपनिवेशिक गलत व्याख्याओं से मुक्त करना आवश्यक है, तो अगला प्रश्न होना चाहिए:
मूल मनुस्मृति को सामने रखकर उसकी प्रत्येक विवादित व्यवस्था का आधुनिक लोकतांत्रिक मूल्यांकन क्यों न किया जाए?
मनुस्मृति का अध्ययन होना चाहिए।
उसका इतिहास पढ़ाया जाना चाहिए।
उसकी भाषा और दर्शन पर शोध होना चाहिए।
लेकिन भारत के आधुनिक संवैधानिक ढाँचे के सामने उसकी सामाजिक व्यवस्थाओं की आलोचनात्मक जाँच भी होनी चाहिए।
भारत का संविधान मनुस्मृति से अपनी वैधता प्राप्त नहीं करता।
उसकी वैधता आती है:
“हम भारत के लोग…”
से।
यही आधुनिक भारत की निर्णायक संवैधानिक क्रांति है।

8. असली सवाल—इस बहस से लाभ किसे ?
यहीं से बहस वास्तव में खोजपरक बनती है।
जब भारत में हिन्दुत्व, धर्मनिरपेक्षता, संविधान और अल्पसंख्यक अधिकारों पर बहस चल रही है, उसी समय मनुस्मृति को पुनः सार्वजनिक बौद्धिक विमर्श के केंद्र में लाने का राजनीतिक प्रभाव क्या होगा?
और जब मुस्लिम शिक्षाविद् RSS नेतृत्व या मनुस्मृति की पुनर्व्याख्या करते हैं, तो क्या अनजाने में हिन्दुत्व को एक नया बौद्धिक वैधता-क्षेत्र मिलता है?
यह कहना कि किसी विद्वान ने जानबूझकर ऐसा किया है, अलग और गंभीर आरोप होगा—जिसके लिए ठोस प्रमाण चाहिए।
लेकिन परिणामों का विश्लेषण करना पूरी तरह वैध है।
किसी वक्ता की नीयत और उसके तर्क का राजनीतिक प्रभाव दो अलग चीजें हैं।

9. “मुस्लिम बुद्धिजीवी” किसी समुदाय के प्रवक्ता नहीं
यह बात भी स्पष्ट रहनी चाहिए।
फ़ैज़ान मुस्तफ़ा और ताहिर महमूद विद्वान हैं।
उनकी राय उनकी अपनी अकादमिक राय है।
वे समूचे भारतीय मुस्लिम समाज के प्रतिनिधि नहीं हैं।
उसी तरह शम्सुल इस्लाम भी सभी मुसलमानों की ओर से नहीं बोलते।
मुस्लिम समाज में RSS और हिन्दुत्व को लेकर अनेक मत हो सकते हैं।
यह विविधता लोकतंत्र की शक्ति है।
समस्या तब पैदा होती है जब अकादमिक प्रतिष्ठा को ऐतिहासिक प्रमाण का विकल्प बना दिया जाए।

10. शम्सुल इस्लाम की मूल चुनौती
शम्सुल इस्लाम की चुनौती का सबसे महत्वपूर्ण पहलू उनका दस्तावेज़ी तरीका है:
भाषणों से आगे बढ़िए।
RSS के अपने दस्तावेज़ पढ़िए।
मनुस्मृति का मूल पाठ पढ़िए।
अम्बेडकर की आलोचना पढ़िए।
संविधान पढ़िए।
और फिर फैसला कीजिए।
यह तरीका व्यक्तियों के बजाय विचारों की जाँच करता है।

11. फैसला यह नहीं कि “बहस कौन जीता?”
असली सवाल यह है:
भारत किस प्रकार का समाज बनना चाहता है?
क्या भारत में हिन्दू सभ्यता और उसकी विविध परंपराओं का अकादमिक अध्ययन होना चाहिए?
हाँ।
क्या मनुस्मृति का अध्ययन होना चाहिए?
हाँ।
क्या मोहन भागवत के समावेशी शब्दों की जाँच और स्वागत किया जा सकता है?
हाँ।
लेकिन साथ ही:
क्या किसी धार्मिक या प्राचीन ग्रंथ को संविधान से ऊपर रखा जा सकता है?
नहीं।
क्या जन्म आधारित सामाजिक पदानुक्रम को आधुनिक लोकतंत्र में पुनर्स्थापित किया जा सकता है?
नहीं।
क्या RSS के ऐतिहासिक दस्तावेज़ों को उसके वर्तमान भाषणों के कारण भुलाया जा सकता है?
नहीं।
और क्या भारत के प्रत्येक नागरिक की समान संवैधानिक गरिमा किसी भी प्राचीन धार्मिक ग्रंथ से नीचे रखी जा सकती है?
बिल्कुल नहीं।

अंतिम प्रश्न
फ़ैज़ान मुस्तफ़ा से सवाल होना चाहिए:
क्या RSS के बदलने का प्रमाण केवल उसके नेताओं के शब्द हैं, या संगठन के सिद्धांत और व्यवहार में भी प्रमाणित परिवर्तन आवश्यक है?
ताहिर महमूद से सवाल होना चाहिए:
यदि मनुस्मृति को औपनिवेशिक गलत व्याख्याओं से मुक्त करना है, तो क्या मूल पाठ को उसके सभी विवादास्पद प्रावधानों सहित जनता के सामने नहीं रखा जाना चाहिए?
और शम्सुल इस्लाम की चुनौती यह है:
इतिहास को भाषणों से नहीं—दस्तावेज़ों से पढ़िए।
अंततः भारत का भविष्य इस प्रश्न से तय नहीं होगा कि मोहन भागवत कितने उदार दिखाई देते हैं।
न ही इससे कि मनुस्मृति की कितनी उदार व्याख्या की जा सकती है।
निर्णायक प्रश्न यह है:
क्या कोई विचार भारत के संविधान में निहित समानता, स्वतंत्रता, गरिमा और बंधुता के सिद्धांतों को स्वीकार करता है?
यदि करता है—उससे संवाद होना चाहिए।
यदि नहीं करता—तो किसी भी बौद्धिक सजावट से वह संवैधानिक नहीं बन सकता।
मनु पहले या संविधान ?
आधुनिक भारतीय गणराज्य का उत्तर स्पष्ट है:
संविधान।

فیضان مصطفیٰ، طاہر محمود اور منوسمرتی کا سوال: پروفیسر شمس الاسلام کے چیلنج کو نظرانداز کیوں نہیں کیا جا سکتا؟

دی انڈین ایکسپریس میں شائع ہونے والی دو تحریروں نے ہندوستانی مسلم دانشور طبقے کے سامنے ایک نہایت اہم سوال کھڑا کردیا ہے۔ جب ممتاز مسلم ماہرینِ تعلیم RSS کی قیادت کے بیانات کی مثبت تشریح کرتے ہیں یا منوسمرتی کو نوآبادیاتی تراجم سے الگ کرکے سمجھنے کی ضرورت پر زور دیتے ہیں، تو سوال پیدا ہوتا ہے:
جائز علمی تعبیر کی حد کہاں ختم ہوتی ہے اور کسی نظریے کی نظریاتی تطہیر یا بحالی کہاں سے شروع ہوتی ہے؟
یہ تنازع محض دو افراد کی آراء کا اختلاف نہیں۔ اس کے مرکز میں ہندوتوا، RSS کی تاریخ، منوسمرتی کے سماجی تصورات اور ہندوستانی آئین کے درمیان تعلق کا بنیادی سوال موجود ہے۔
اس بحث کے ایک طرف پروفیسر فیضان مصطفیٰ اور پروفیسر طاہر محمود ہیں، جبکہ دوسری طرف پروفیسر شمس الاسلام ہیں، جن کی تحقیق RSS اور ہندوتوا کی نظریاتی و دستاویزی تاریخ پر مرکوز رہی ہے۔
اصل سوال یہ ہے:
کیا آج کے RSS کو صرف اس کی موجودہ قیادت کی تقریروں سے سمجھا جاسکتا ہے، یا اس کے تاریخی دستاویزات اور نظریاتی لٹریچر کو بھی ساتھ پڑھنا ضروری ہے؟

1۔ فیضان مصطفیٰ اور موہن بھاگوت کا سوال
پروفیسر فیضان مصطفیٰ نے دی انڈین ایکسپریس میں موہن بھاگوت کے نیویارک/Madison Square Garden خطاب اور ہندوتوا کی ان کی تشریح پر ایک مثبت نقطۂ نظر پیش کیا ہے۔
ان کا استدلال یہ رہا ہے کہ جب معاشرے میں نفرت اور ’’دوسرے‘‘ کو الگ کرنے کا رجحان بڑھ رہا ہو تو RSS سربراہ کے ایسے الفاظ کو اہمیت دی جانی چاہیے جو رواداری اور شمولیت کی بات کرتے ہیں۔
یہ بذاتِ خود RSS کی حمایت کا ثبوت نہیں۔
لیکن یہاں ایک بنیادی سوال ضرور پیدا ہوتا ہے:
کیا کسی تنظیم کے موجودہ سربراہ کے نرم اور مفاہمتی الفاظ اس تنظیم کی تاریخی نظریاتی دستاویزات کی جگہ لے سکتے ہیں؟
اگر RSS قیادت کہتی ہے کہ ہندوتوا تنگ نظری پر مبنی نہیں، تو اس دعوے کو صرف تقریر سے نہیں بلکہ تنظیم کی تاریخ، لٹریچر اور عملی کردار سے بھی پرکھنا ہوگا۔

2۔ طاہر محمود اور منوسمرتی کی بحث
دوسرا اور شاید زیادہ حساس تنازع پروفیسر طاہر محمود کے دی انڈین ایکسپریس میں شائع مضمون سے متعلق ہے، جس میں انہوں نے منوسمرتی کو نوآبادیاتی نقطۂ نظر سے پڑھنے کے خلاف احتیاط کی ہے۔
ان کا بنیادی استدلال یہ ہے کہ منوسمرتی اور دیگر دھرم شاستری متون کو ان کے تاریخی پس منظر میں سمجھنا چاہیے اور یہ فرض نہیں کرنا چاہیے کہ ان کی ہر ہدایت ہر دور میں لفظ بہ لفظ نافذ رہی ہوگی۔
ایک مورخ کے لیے یہ ایک جائز علمی سوال ہے۔
لیکن دوسرا سوال بھی اتنا ہی اہم ہے:
کیا منوسمرتی کا تاریخی پس منظر بیان کرنا اور منوسمرتی کا اخلاقی دفاع یا احیا کرنا ایک ہی بات ہے؟
ہرگز نہیں۔
کسی امتیازی متن کا مطالعہ اس کی حمایت نہیں ہوتا۔
کسی قدیم نظام کی وضاحت اس کے جدید احیا کا مطالبہ نہیں ہوتی۔
لیکن اگر تاریخی سیاق و سباق پیش کرتے ہوئے اس کے امتیازی، ذات پات پر مبنی یا خواتین سے متعلق غیر مساوی احکامات کو پسِ پشت ڈال دیا جائے تو بحث کا رخ ضرور بدل جاتا ہے۔

3۔ شمس الاسلام کا دستاویزی چیلنج
یہیں پروفیسر شمس الاسلام کی مداخلت اہم ہوجاتی ہے۔
شمس الاسلام طویل عرصے سے RSS کی اپنی مطبوعات اور نظریاتی لٹریچر کو سامنے لاکر یہ سوال اٹھاتے رہے ہیں کہ تنظیم کو صرف اس کے موجودہ رہنماؤں کے بیانات سے کیوں پرکھا جائے؟
ان کا اصرار ہے:
RSS کو اس کی اپنی دستاویزات سے پڑھئے۔
مثلاً 1949 میں آئین ساز اسمبلی کی جانب سے ہندوستانی آئین منظور کیے جانے کے فوراً بعد RSS کے ترجمان Organiser میں شائع ہونے والے ایک اداریے میں قدیم ہندوستانی آئینی روایات کا حوالہ دیتے ہوئے منو کے قوانین کا ذکر کیا گیا تھا۔
اس سے ایک اہم تاریخی سوال پیدا ہوتا ہے:
اگر آئین جدید ہندوستان میں مساوات اور شہری حقوق کی بنیاد تھا، تو اس دور میں RSS کے نظریاتی لٹریچر میں منو کے قوانین کو کیوں پیش کیا گیا؟
یہ محض نوآبادیاتی ترجمے کا مسئلہ نہیں۔
یہ ہندوستان کی سیاسی تاریخ کا سوال ہے۔

4۔ منوسمرتی کا مسئلہ صرف “ترجمہ” کا مسئلہ نہیں
اگر کسی نوآبادیاتی ترجمے میں غلطی ہے تو اسے درست کیا جانا چاہیے۔
اگر کسی شلوک کا سیاق غلط سمجھا گیا ہے تو سیاق واضح کیا جانا چاہیے۔
اگر مغربی محققین نے منوسمرتی کی غلط تعبیر کی ہے تو ہندوستانی علماء کو اس کی اصلاح کرنی چاہیے۔
لیکن اس کے بعد بھی بنیادی سوال باقی رہتا ہے:
اصل سنسکرت متن حقیقت میں کیا کہتا ہے؟
اور اس سے بھی زیادہ اہم سوال:
ہندوستانی معاشرے نے تاریخی طور پر اس متن کو کس طرح استعمال کیا؟
خواتین، ذات پات اور سماجی درجہ بندی سے متعلق منوسمرتی کے احکامات پر بحث کو صرف یہ کہہ کر ختم نہیں کیا جاسکتا کہ ’’نوآبادیاتی ترجمہ غلط تھا۔‘‘
اصل متن سامنے لائیے۔
اس کی مختلف علمی تشریحات سامنے لائیے۔
پھر عوام کو فیصلہ کرنے دیجئے۔

5۔ امبیڈکر کو اس بحث سے الگ نہیں کیا جاسکتا
منوسمرتی پر بحث ڈاکٹر بی آر امبیڈکر کے بغیر نامکمل ہے۔
25 دسمبر 1927 کو مہاڑ تحریک کے دوران امبیڈکر اور ان کے ساتھیوں نے منوسمرتی کی ایک نقل نذرِ آتش کرکے ذات پات پر مبنی عدم مساوات کے خلاف علامتی احتجاج کیا تھا۔
یہ کسی برطانوی مترجم کا ردعمل نہیں تھا۔
یہ ہندوستان کے اندر سے اٹھنے والی سماجی انصاف کی ایک طاقتور تحریک تھی۔
اور یہی وہ مقام ہے جہاں جدید ہندوستان کی سب سے بڑی نظریاتی تبدیلی سامنے آتی ہے:
منوسمرتی کی سماجی درجہ بندی کی روایت بمقابلہ آئین کی شہری مساوات۔
ہندوستانی آئین کسی فرد کی قدر اس کی ذات، پیدائش یا سماجی حیثیت کی بنیاد پر متعین نہیں کرتا۔
اس کی بنیاد ہے:
انصاف، آزادی، مساوات اور اخوت۔

6۔ فیضان مصطفیٰ سے اصل سوال
پروفیسر فیضان مصطفیٰ سے ایک سیدھا علمی سوال کیا جانا چاہیے:
RSS پر اعتماد کرنے کا معیار کیا ہونا چاہیے؟
ایک تقریر؟
ایک ملاقات؟
ایک عوامی بیان؟
یا پھر تنظیم کے نظریاتی لٹریچر اور عملی کردار میں حقیقی تبدیلی؟
اگر موہن بھاگوت شمولیت اور رواداری کی بات کرتے ہیں تو ان الفاظ کا خیرمقدم کیا جاسکتا ہے۔
لیکن یہی معیار تمام سیاسی تنظیموں پر لاگو ہونا چاہیے۔
الفاظ کو ادارہ جاتی کردار اور تاریخی ریکارڈ سے پرکھنا چاہیے۔

7۔ طاہر محمود سے بھی سوال
اگر منوسمرتی کو نوآبادیاتی غلط تعبیرات سے آزاد کرکے سمجھنا ضروری ہے تو اگلا سوال یہ ہونا چاہیے:
اصل منوسمرتی کو سامنے رکھ کر اس کی ہر متنازع سماجی ہدایت کا جدید جمہوری اصولوں کی روشنی میں جائزہ کیوں نہ لیا جائے؟
منوسمرتی کا مطالعہ ہونا چاہیے۔
اس کی تاریخ پڑھائی جانی چاہیے۔
اس کی زبان اور فلسفے پر تحقیق ہونی چاہیے۔
لیکن جدید ہندوستان کے آئینی نظام کے سامنے اس کے سماجی تصورات کا تنقیدی جائزہ بھی ضروری ہے۔
ہندوستانی آئین اپنی قانونی حیثیت منوسمرتی سے حاصل نہیں کرتا۔
اس کی بنیاد ہے:
’’ہم بھارت کے لوگ…‘‘
یہی جدید ہندوستان کا فیصلہ کن آئینی انقلاب ہے۔

8۔ اصل سوال: اس بحث سے فائدہ کس کو؟
یہیں سے بحث واقعی تحقیقاتی شکل اختیار کرتی ہے۔
جب ہندوستان میں ہندوتوا، سیکولرازم، آئین اور اقلیتوں کے حقوق پر بحث جاری ہے، تو اسی وقت منوسمرتی کو دوبارہ عوامی فکری بحث کے مرکز میں لانے کا سیاسی اثر کیا ہوگا؟
اور جب مسلم ماہرینِ تعلیم RSS قیادت یا منوسمرتی کی نئی تعبیر پیش کرتے ہیں تو کیا غیر ارادی طور پر ہندوتوا کو ایک نیا فکری جواز فراہم ہوتا ہے؟
یہ کہنا کہ کسی مخصوص عالم نے جان بوجھ کر ایسا کیا، ایک الگ اور سنگین الزام ہوگا—جس کے لیے ٹھوس ثبوت ضروری ہیں۔
لیکن کسی دلیل کے سیاسی نتائج کا تجزیہ کرنا ایک بالکل جائز علمی عمل ہے۔
کسی مقرر کی نیت اور اس کی دلیل کے سیاسی اثرات دو الگ چیزیں ہیں۔

9۔ ’’مسلم دانشور‘‘ پوری مسلم قوم کے نمائندے نہیں
یہ بات بھی واضح رہنی چاہیے۔
فیضان مصطفیٰ اور طاہر محمود علماء اور ماہرینِ تعلیم ہیں۔
ان کی آراء ان کی اپنی علمی آراء ہیں۔
وہ پورے ہندوستانی مسلم معاشرے کی نمائندگی نہیں کرتے۔
اسی طرح شمس الاسلام بھی تمام مسلمانوں کی طرف سے نہیں بولتے۔
مسلمانوں میں RSS اور ہندوتوا کے بارے میں مختلف آراء ہوسکتی ہیں۔
یہ تنوع جمہوریت کی طاقت ہے۔
مسئلہ اس وقت پیدا ہوتا ہے جب:
علمی شہرت کو تاریخی ثبوت کا متبادل بنا دیا جائے۔

10۔ شمس الاسلام کا بنیادی چیلنج
شمس الاسلام کے چیلنج کا سب سے اہم پہلو ان کا دستاویزی طریقۂ کار ہے:
تقریروں سے آگے بڑھئے۔
RSS کی اپنی دستاویزات پڑھئے۔
منوسمرتی کا اصل متن پڑھئے۔
امبیڈکر کی تنقید پڑھئے۔
آئین پڑھئے۔
اور پھر فیصلہ کیجئے۔
یہ طریقہ شخصیات کے بجائے نظریات کی جانچ کرتا ہے۔

11۔ فیصلہ یہ نہیں کہ ’’بحث کون جیتا؟‘‘
اصل سوال یہ ہے:
ہندوستان کس قسم کا معاشرہ بننا چاہتا ہے؟
کیا ہندوستان میں ہندو تہذیب اور اس کی مختلف روایات کا علمی مطالعہ ہونا چاہیے؟
ہاں۔
کیا منوسمرتی کا مطالعہ ہونا چاہیے؟
ہاں۔
کیا موہن بھاگوت کے مفاہمتی اور شمولیتی بیانات کا جائزہ لیا جاسکتا ہے؟
ہاں۔
لیکن ساتھ ہی:
کیا کسی مذہبی یا قدیم متن کو آئین سے بالاتر رکھا جاسکتا ہے؟
نہیں۔
کیا پیدائشی سماجی درجہ بندی کو جدید جمہوریت میں دوبارہ قائم کیا جاسکتا ہے؟
نہیں۔
کیا RSS کی تاریخی دستاویزات کو اس کے موجودہ بیانات کی وجہ سے فراموش کیا جاسکتا ہے؟
نہیں۔
اور کیا ہندوستان کے ہر شہری کی آئینی مساوات اور انسانی وقار کو کسی قدیم مذہبی متن سے کمتر قرار دیا جاسکتا ہے؟
بالکل نہیں۔

آخری سوال
فیضان مصطفیٰ سے سوال ہونا چاہیے:
کیا RSS کے بدلنے کا ثبوت صرف اس کے رہنماؤں کے الفاظ ہیں، یا تنظیم کے نظریے اور عمل میں ثابت شدہ تبدیلی بھی ضروری ہے؟
طاہر محمود سے سوال ہونا چاہیے:
اگر منوسمرتی کو نوآبادیاتی غلط تعبیرات سے آزاد کرنا ضروری ہے تو کیا اصل متن کو اس کے تمام متنازع احکامات سمیت عوام کے سامنے پیش نہیں کیا جانا چاہیے؟
اور شمس الاسلام کا چیلنج یہ ہے:
تاریخ کو تقریروں سے نہیں—دستاویزات سے پڑھئے۔
آخرکار ہندوستان کا مستقبل اس بات سے طے نہیں ہوگا کہ موہن بھاگوت کتنے معتدل دکھائی دیتے ہیں۔
نہ ہی اس بات سے کہ منوسمرتی کی کتنی نرم تشریح کی جاسکتی ہے۔
فیصلہ کن سوال یہ ہے:
کیا کوئی نظریہ ہندوستان کے آئین میں موجود مساوات، آزادی، انسانی وقار اور اخوت کے اصولوں کو تسلیم کرتا ہے؟
اگر کرتا ہے تو اس سے مکالمہ ہونا چاہیے۔
اگر نہیں کرتا تو کسی بھی علمی آرائش سے اسے آئینی نہیں بنایا جاسکتا۔
منو پہلے یا آئین؟
جدید ہندوستانی جمہوریہ کا جواب واضح ہے:
آئین۔
